महसूल खात्याची प्रतिमा सुधारा - पतंगराव कदमशिर्डी, ता. २७ - ""तालुक्‍यात सर्वाधिक वेतनश्रेणी, बसायला गाडी, गाडीवर पिवळा दिवा आणि पुरेसे इंधन देऊ, रिक्त पदे भरू आणि सर्वांना प्रशिक्षण देऊन "हायटेक' करू.मात्र, तुम्ही लोकांची कामे वेळेवर करा. त्यांना हेलपाटे मारायला लावू नका. पैसे दिल्याशिवाय काम होत नाही, असा समज होता कामा नये. रोज एका तरी गरिबाचे काम करून द्या. महसूल खात्याची प्रतिमा सुधारा,'' अशी सूचना महसूलमंत्री पतंगराव कदम यांनी शनिवारी राज्यातील तहसीलदार आणि नायब तहसीलदारांना केली. तहसीलदार व नायब तहसीलदार संघटनेच्या येथे झालेल्या राज्यव्यापी अधिवेशनात ते बोलत होते. या वेळी साई संस्थानचे अध्यक्ष आमदार जयंत ससाणे, महसूल महासंघाचे अध्यक्ष बी. डी. शिंदे, संघटनेचे अध्यक्ष एन. डी. मालोदे, विभागीय महसूल आयुक्त डॉ. संजय चहांदे, ओमप्रकाश देशमुख, जिल्हाधिकारी डॉ. पी. अन्बलगन, अप्पर जिल्हाधिकारी बाबूराव केंद्रे, उपनिवासी जिल्हाधिकारी भाऊसाहेब दांगडे आदी व्यासपीठावर उपस्थित होते. तहसीलदारांना तालुक्‍यात इतर अधिकाऱ्यांच्या तुलनेत अधिक वेतनश्रेणी असावी, रिक्त पदे भरली जावीत, गाडी व गाडीला इंधन मिळावे. गाडीवर पिवळा दिवा लावण्याची परवानगी मिळावी, माहिती तंत्रज्ञानासह अन्य आवश्यक ते प्रशिक्षण मिळावे, संगणक-लॅपटॉप मिळावेत आदी प्रमुख मागण्या संघटनेने या अधिवेशनात केल्या. सुधारित वेतनश्रेणीसह सर्व मागण्या आपल्याला तत्त्वतः मान्य आहेत. विधिमंडळाचे अधिवेशन सुरू असल्याने घोषणा करणार नाही. मात्र, मंत्रिमंडळाच्या बैठकीत त्या मार्गी लावू, असे आश्‍वासन कदम यांनी दिले. कदम म्हणाले, ""शेतकऱ्यांना सातबाराचा उतारा अथवा नागरिकांना रेशनकार्ड वेळेवर मिळते का, खाली दाद लागत नाही म्हणून नागरिक मंत्रालयात गर्दी करतात, असे का होते, याचे उत्तर शोधायला हवे. चुकीचे वागू नका, लोकप्रतिनिधी चुकीची कामे सांगत असतील, तर दबावाखाली येऊ नका. आपले खाते राज्यात क्रमांक दोनचे आहे. तुम्ही राज्यासाठी वर्षाकाठी पंधरा-वीस हजार कोटी रुपयांचा महसूल गोळा करून देता. तुम्हाला आवश्यक ते सर्व काही द्यायलाच हवे. आठ महिन्यांत आपल्याला खात्याचा चेहरामोहरा बदलायचा आहे. त्यासाठी "यशदा'मार्फत वर्षाकाठी किमान शंभर तहसीलदारांना प्रशिक्षण देऊ. प्रत्येक जिल्ह्यात महसूल भवन बांधू.'' या वेळी चहांदे, कचरे, यांचीही भाषणे झाली. प्रास्ताविक बाळासाहेब वाकचौरे यांनी केले. सूत्रसंचालन विकास शिवगजे यांनी केले, तर राहात्याचे तहसीलदार यशवंत माने यांनी आभार मानले. ----------------------------------------------------- जिल्ह्यात केवळ जिल्हाधिकारीच! तहसीलदारांची इंधनखर्चाची तब्बल चार कोटी रुपयांची थकबाकी राज्य सरकारकडे आहे. विदर्भातील एका जिल्ह्यात केवळ जिल्हाधिकारी आहेत. उर्वरित सर्व महसुली पदे रिक्त आहेत, अशी माहिती खुद्द महसूलमंत्र्यांनीच दिली. -----------------------------------------------------

युनिकोड : वैश्विकतेचा नवा मन्त्र २१ ऑक्टोबर, २००८जागतिकीकरणाच्या रेट्यात व्यवहारभाषा आणि ज्ञानभाषा म्हणून मराठीला समृद्ध करण्याचा उपाय म्हणून युनिकोडकडे पाहिले जाते. आपल्या संगणकावर जेवढ्या प्रक्रिया इंग्रजी भाषेवर करता येतात त्या सार्‍या प्रक्रिया आता मराठी भाषेवरही करता येतात. या आधुनिक तंत्रज्ञानाची ओळखही ऑक्टोबरच्या लोकराज्यमध्ये करून देण्यात आलीय.संगणकावरील मराठीच्या वापरात युनिकोडचा अनिवार्यपणे वापर करावा यासाठीचे परिपत्रक नुकतेच महाराष्ट्र शासनाने काढले आहे. मराठीच्या विकासाची आधुनिक तंत्रज्ञानाशी प्रभावी सांगड घालण्याच्या दृष्टीने शासनाने उचलेले हे महत्त्वाचे पाऊल आहे. युनिकोड ही भारत सरकारसह सार्‍या जगाने मान्य केलेली सार्वत्रिक अशी व्यवस्था आहे. युनिकोड कन्सॉर्शियम या संस्थेनं जगभरातील सर्व भाषांच्या संगणकावरील वापराचे प्रमाणीकरण केले. त्यातून मराठीसह सर्व भारतीय भाषांना संगणकविश्वात आज मानाचे स्थान मिळाले आहे. संगणकावरील मराठीच्या वापरातल्या सार्‍या समस्या मुळापासून नाहीशा करण्याची क्षमता या व्यवस्थेमध्ये आहे. मुख्य म्हणजे ती कुणालाही मोफत उपलब्ध आहे. विंडोजच्या २००० पुढच्या सर्व आवृत्त्यात व लिनक्सच्याही सर्व अद्ययावत आवृत्त्यांत युनिकोड अंगभूतपणे आहे. कोणत्याही बाहेरुन बसवलेल्या सॉफ्टवेअरशिवाय तुम्ही जगातल्या कुठल्याही कोपर्‍यातल्या माणसाला मराठीतून मेल पाठवू शकता. त्यालाही ते विनासायास वाचता येते. ही अत्यंत सुखावणारी गोष्ट आहे.केंद्रशासनाने युनिकोडच्या प्रसारासाठी व संगणकावरील भारतीय भाषांच्या विकासासाठी लक्षणीय प्रयत्न केले आहेत. भारत सरकारच्या www.ildc.gov.in या संकेतस्थळावर विविध युनिकोड फॉन्टससह अनेक सोई डाऊनलोड करता येतात. (या संकेतस्थळावर नाव नोंदणी केली तर ते आपल्या पत्त्यावर मोफत सीडीही पाठवून देतात!)युनिकोडमधील नेटवरचा मजकूर शोधण्यायोग्य (सर्चेबल) असतो. गुगल किंवा याहूसारखे सर्च इंजिन मराठीतून तुम्हाला हवा तो मजकूर शोधून देते. ही अत्यंत क्रांतिकारक गोष्ट आहे. आपल्या संगणकावर जेवढ्या संगणकीय प्रक्रिया इंग्रजी भाषेवर करता येतात त्या सार्‍या प्रक्रिया युनिकोडमुळे आता मराठी भाषेवरही करता येतात. अकारविल्हे (सॉर्टिंग) लावता येते. मोठामोठ्या सूच्या, याद्या मराठीतून करायला आता कोणतीच अडचण येत नाही. मराठीतून ऑनलाईन फॉर्म भरणे, तक्रारी वा प्रतिक्रिया नोंदवणे अशा अनेक गोष्टी आता शक्य आहेत. आता संगणकावरील मराठीचे शुद्धलेखन तपासनीसही (स्पेलचेकर्स) उपलब्ध आहेत. त्यांचा अधिकाधिक अचूकतेकडे प्रवास सुरु आहे. एकूण युनिकोड हा इ-शासनाचा पायाच आहे.अशा या युनिकोडचा वापर मुंबई महानगरपालिकेने २००२ सालापासूनच सुरू केला आहे. या प्रयोगाच्या सार्वत्रिकीकरणासाठी केले जाणारे प्रयत्न, आयोजित कार्यशाळा तसेच इंटरनेटवर याविषयी कोठे माहिती उपलब्ध आहे, याविषयी जाणून घेण्यासाठी http://www.mahanews.gov.in/ Lokrajya

चौकटीत राहून चौकटीबाहेर काम करणार्‍या कर्तृत्ववान व्यक्तिमत्त्वांची दखल घेणारे सदर. त्यांनी केलेले प्रयोग साधे वाटले तरी त्यातून साकारलेले विश्व आपणासही निश्चित प्रेरणादायी ठरेल.डॉ.संजय चहांदे हे नाशिक महसूल विभागीय आयुक्त म्हणून काम पाहतात. काही काळ त्यांनी माहिती व जनसंपर्क महासंचालनालयाचे महासंचालक म्हणूनही काम पाहिले होते. त्यांची स्वत:ची एक कार्यशैली आहे. जे काम करायचं ते अत्यंत लोकाभिमुख. लोकांना त्याचा फायदा झाला पाहिजे यासाठी त्यांचा सतत प्रयत्न असतो. शासकीय योजना लोकांपर्यंत जाण्यासाठी शासकीय यंत्रणेने कार्यकर्त्याची भूमिका घेतली पाहिजे, यावर त्यांचा ठाम विश्वास आहे. त्यातून रुजली 'ग्रामस्थ दिन'ची अभिनव संकल्पना. शासनाचा निर्णय नसताना केवळ नाशिक विभागासाठी योजना आणि त्याचे फलित, लोकांचे प्रश्न आणि शासनाने केलेली सोडवणूक याचा लेखाजोखा अगदी आमने-सामने प्रत्येक गावागावातून या माध्यमातून पुढे आला. यातून शासकीय अधिकार्‍याचे व कर्मचार्‍याचे प्रश्न कमी झाले आणि जनतेच्या तक्रारी कमी झाल्या. ग्रामस्थ दिन दिवसेंदिवस अपेक्षित परिणाम दाखवू लागले. विकासाचे नवे पर्व नाशिक महसूल विभागात सुरु झाले. गावातील प्रश्न नेमके काय आहेत, हे समजल्याने नियोजन करतांना या प्रश्नांचा विचार होत गेला. यंत्रणा कुठे कमी पडते आहे काय? हे समजले. त्यात सुधारणा करण्यास वाव मिळाला. पर्यायाने लोकांसाठी शासन ही भूमिका या माध्यमातून गावात रुजली.एक जानेवारी,२००७ पासून महिन्याच्या दर बुधवारी संपूर्ण विभागात ग्रामस्थ दिन राबविला जातो. ग्रामस्तरावर तलाठी, ग्रामसेवक तसेच शासनाच्या विविध विभागातील अधिकारी, कर्मचारी कार्यरत असतात. त्यांना ग्रामीण जीवनाची, समस्यांची जाण चांगली असते. पण समन्वयाचा अभाव असतो. त्यामुळे ग्रामस्तरावरील समस्या /अडचणी सोडविण्यासाठी त्यांच्यात परस्पर समन्वय घडवून आणण्याच्या दृष्टीने नाशिक विभागात 'ग्रामस्थ दिन' दर बुधवारी आयोजित केला जातो.शासकीय अधिकारी, कर्मचारी यांच्या जबाबदारीच्या भूमिका स्पष्ट करणार्‍या कायद्यातील तरतूदींचे प्रभावी पालन व्हावे. तसेच ग्रामस्तरावरील अधिकारी, कर्मचारी, लोकप्रतिनिधी, ग्रामस्थ, स्वयंसेवी संस्था यांच्यामध्ये चांगला समन्वय प्रस्थापित व्हावा. विविध शासकीय सेवांचे वितरण व विविध कल्याणकारी योजनांचा फायदा खर्‍या लाभार्थीपर्यंत विना तक्रार मिळावा, त्याचा खुलेपणाने मासिक आढावा घेता यावा यासाठी 'ग्रामस्थ दिन' उपक्रम आहे.ग्रामस्थ दिनामध्ये ग्रामपातळीवरील सर्व विभागाचा आढावा व चर्चा होते. संत गाडगेबाबा ग्रामस्वच्छता अभियान, हागणदारी मुक्ती योजना, महाराष्ट्र ग्रामीण रोजगार हमी योजना, महिला बचतगट, सर्व शिक्षा अभियान, पुरुष नसबंदी या आणि अन्य कार्यक्रमानुसार ग्रामीण लोकसहभागावर चर्चा व आढावा घेण्यात येतो. उपस्थित ग्रामस्थांच्या तक्रारी ऐकुन त्या सोडविल्या जातात. दुसर्‍या टप्प्यात ग्रामस्तरावरील प्रत्येक शासकीय अधिकारी, कर्मचारी ते देत असलेल्या सेवांचा तपशील, राबवित असलेल्या योजनांची माहिती व आपआपल्या कामकाजाचा आढावा ग्रामस्थ दिनात मांडतात. अधिकार्‍यांच्या कामकाजासंदर्भात अडचणी मांडल्या जातात. ग्रामपालक अधिकारी हे नोंदवून घेतात. लेखी तक्रारी, निवेदने असल्यास ती स्वीकारतात. हे सारे पहिल्या सत्रात होते. दुसर्‍या सत्रात उपस्थित गावकर्‍याच्या साक्षीने गावात असणार्‍या सर्व सरकारी विभागांना एकत्रित भेट दिली जाते. त्यात जिल्हा परिषद शाळा, रेशन दुकान, रॉकेल डेपो, ग्रामपंचायत कार्यालय, तलाठी कार्यालय, प्राथमिक आरोग्य केंद्र यांचा समावेश असतो. या समस्या स्थानिक स्तरावर सात दिवसात सोडविणे अपेक्षित असते. तसे शक्य नसल्यास सक्षम अधिकार्‍यांकडे संबंधीत ग्राम अधिकारी पाठपुरावा करुन पुढील ग्रामस्थ दिनापूर्वी त्यावर आवश्यक कारवाई केली जाते.
नाशिक विभागातील ग्रामस्थ दिनग्रामपंचायतींची संख्या - ४८८६१ मे २००७ ते ऑगस्ट २००८ पर्यंत ग्रामस्थदिन - प्रत्येक गांवात ९ वेळा ग्रामस्थदिनग्रामस्थ उपस्थिती - १४ लाख ४ हजार ७४४अधिकारी-कर्मचारी उपस्थिती - ५७ हजार १२३प्राप्त तक्रारी -६४ हजार ६७७तक्रारींचे निराकरण - ६१ हजार ००८तक्रारींवर कार्यवाही सुरु - ३६६९ग्रामस्थ दिनामध्ये ग्रामस्थांचा वाढता सहभाग हा नोकरशाहीवरील जनतेचा अंकुशही ठरत आहे. या कार्यक्रमाचे संनियंत्रण त्रिस्तरीय पध्दतीने होते. विभागीय स्तरावर विभागीय आयुक्त, जिल्हास्तरावर जिल्हाधिकारी व तालुकास्तरावर तहसिलदार हे ग्रामस्थ दिन कार्यक्रमाचे समन्वयक व संनियंत्रण अधिकारी म्हणुन काम पाहतात. डॉ. संजय चहांदे यांची ही संकल्पना नाशिक महसूल विभागात जानेवारी-२००७ ते मार्च-२००७ या तीन महिन्याच्या कालावधतीपर्यंत प्रायोगिक तत्त्वावर राबविण्यात येणार होती. पण संपुर्ण विभागात ग्रामपातळीवर याला मिळणार्‍या सहभागामुळे ही संकल्पना आता एका सामाजिक चळवळ झाली आहे. डॉ.संजय चहांदे ग्रामीण भागातून पुढे आले. भारतीय प्रशासकीय सेवेत प्रवेश मिळविला. आपल्या प्रशासकीय अधिकाराचा उपयोग सर्वसामान्य माणसांकरिता करण्यात यावा, यासाठी नेहमीच त्यांचा अट्टाहास राहिला. त्याचाच परिणाम म्हणून ग्रामस्थ दिन ही नवीन संकल्पना पुढे आली. जिल्हाधिकार्‍यापासून ते थेट तलाठ्यापर्यंत, मुख्य कार्यकारी अधिकार्‍यापासून ते थेट ग्रामसेवकापर्यंत सारेच लोक कामाला लागले. त्याचा परिणाम दिसून आला. डॉ.संजय चहांदे खर्‍या अर्थाने ग्रामस्थ दिनाच्या संकल्पनेतून चौकटीबाहेरचे अधिकारी ठरले. Revenue Officers loosing their powers
It is learnt that powers of Collector under section 42, 44, 45, 47A, 176 to 223 of MLRC of issuing NA permission in Municipal Corporation area are being given to Municipal Commissioner. Powers of NA recovery and recovery of Conversion Tax also will be recovered by Municipal Corporation. An amendment to section 42 is being moved. This will not in anyway reduce the workload, but certainly it will take away the powers and authority of revenue officers. This calls for introspection and academic scrutiny of this likely decision of the Government.

As all are aware, Our Tahasildars have handed over keys of their vehicles to respective Collectors on 2nd October 2008 in protest of inaction on the part of Govt. to make available adequate grants. In an unprecendented mode, Govt. has sought an Advance from Consolidated Fund, which is usually sought very rarely and as exception. A CFA Advance of Rs. 2,63,78,000 has been sanctioned. Divcom Kokan Rs.40,92,000, Divcom Nashik 30,54,000, Divcom Pune 26,50,000, Divcom Amaravati Rs. 1,16,09,000, Divcom Aurangabad 49,73,000/-. Nagpur Division seems not to have sent their proposal of pending bills, now it is sent on 4th Oct. and it may be processed separately.
जिल्ह्यातील १३ तहसीलदारांनी वाहने केली जमाजळगाव
जिल्ह्यातील १३ तहसीलदारांनी वाहने केली जमाजळगाव, ता. १ - जिल्ह्यातील तहसील कार्यालयांना शासनाकडून देण्यात आलेली वाहनांसाठी दिला जाणारा निधी नऊ वर्षापासून प्राप्त झाला नसल्याने आज अखेर १३ तहसीलदारांनी आपली वाहने जिल्हाधिकारी कार्यालयात आणून जमा केलीत आहेत. जिल्ह्यात असलेल्या तहसीलदारांना शासनातर्फे शासनाची विविध कामे करण्यासाठी वाहने दिली आहेत. नैसर्गिक आपत्ती, विविध योजनांची गावोगावी भेटी देऊन जनजागृती करणे, शेती, रस्ता न्यायनिवाडा, तक्रारींचा गावावर जाऊन निपटारा करणे आदी कामे तहसीलदार ह्या वाहनांचा वापर करून करीत असतात. मात्र, या वाहनांना इंधनासाठी लागणार निधी तब्बल नऊ वर्षापासून या कार्यालयांना मिळाला नसल्याचे विदारक चित्र जिल्ह्यात आहे. वारंवार मागणी करून अद्यापही निधी न मिळाल्याने आज सायंकाळी तहसीलदारांनी आपली वाहने जिल्हाधिकारी कार्यालयात आणून जमा केलीत. तहसीलदारांनी वाहने जमा केल्याचे पाहून जिल्हाधिकाऱ्यांनी तत्काळ त्यांना एक पत्र दिले. यात तहसील विभागाच्या अखत्यारित येणारे कुठलेही काम हे वाहन नसल्याने झाले नाही, अशी सबब ऐकून घेतली जाणार नाही. तसेच अत्यावश्‍यक कामे ही राहणार नाही याची दक्षता घ्यावी, असे नमूद केले आहे. या संदर्भात तहसीलदारांच्या वतीने वाहनाशिवाय कुठलेही शासकीय काम राहणार नाही याची जबाबदारी आमची असेल. आम्ही शासकीय वाहनाशिवाय ती कामे पूर्ण करू असे आश्‍वासन तहसीलदार राहुल मुंडके यांनी जिल्हा प्रशासनाला दिले. ----------------------------------- दोन तालुके वाहनाविना जिल्ह्यातील पंधरा तालुक्‍यांपैकी तेरा तालुक्‍यांना शासकीय वाहन आहे. यात पारोळा व बोदवड तालुक्‍याचा समावेश आहे. तसेच गेल्या वर्षी जिल्हाप्रशासनाकडून १७ नवीन वाहनांचा प्रस्ताव शासनाला पाठविण्यात आला होता. त्यापैकी अवघी तीन वाहने जिल्ह्याला मिळाली आहेत. तसेच सध्या असलेल्या वाहनांची अवस्थाही बिकट झाली आहे. ती वाहने वापरण्यापेक्षा खासगी वाहनाने गेलेले बरे असे तहसीलदारांना म्हणावे लागत आहे. ----------------------------------- २२ लाख रुपये थकीत जिल्ह्यात एकूण १९ शासकीय वाहने देण्यात आली आहेत. यात चार प्रांताधिकाऱ्यांचा समावेश आहे. १५ तालुक्‍यातील पारोळा व बोदवड तालुक्‍याने आपली वाहने गेल्या वर्षापासून जमा केली आहेत. शासनाकडून इंधनासाठी पैसा न मिळाल्याने तहसील विभागाची पेट्रोलपंपावरील पत संपली आहे. तहसील विभागाच्या वाहनात इंधन टाकण्यास चालक स्पष्ट नकार देत असल्याचे तहसीलदारांनी सांगितले. दरम्यान, या १९ वाहनांना लागलेल्या इंधनाची २२ लाख २८ हजार ६७६ रुपयांची रक्कम शासनाकडून प्राप्त होणे बाकी असल्याची माहिती जिल्हा प्रशासनाकडून देण्यात आली. तालुकानिहाय इंधनाची थकीत रक्कम व कंसात वर्ष : जळगाव ३ लाख २ हजार ६८४ (१९९९ ते २००६), एरंडोल ९४ हजार ७४१(२००६ ते २००७), धरणगाव ६७ हजार ४५३ (२००१ते २००२), जामनेर ५३ हजार २९१ (२००३-२००४-०८), भुसावळ २५ हजार ६१७ (२००७-२००८), यावल १ लाख २९ हजार ५४५ (२००२-०२ ते २००६-०७), रावेर १ लाख ४ हजार ७५५ (१ एप्रिल ०७ ते ३० सप्टेंबर ०८), मुक्ताईनगर १ लाख ६३ हजार २१३ (२००१ ते ३१ जुलै ०७), बोदवड ९ हजार २७ (२००७), पाचोरा १ लाख ४४ हजार ७५३ (२०००-०१ ते २००६-०७), चाळीसगाव ५३ हजार २९० (२००७), भडगाव ९९ हजार ८६४(२००५-०६), अमळनेर ७९ हजार ५२५ (२००६-०७), पारोळा १ लाख ५८ हजार ४१५ (१९९९-२००० ते २००६-०७), चोपडा २ लाख ३१हजार ८५४ (२०००-०१ ते २००५- ०६), जळगाव प्रांताधिकारी १० हजार १४१ (२००६), भुसावळ प्रांताधिकारी ३ लाख ७ हजार ९६१ (२०००-०१ ते २००६-०७), अमळनेर प्रांताधिकारी ९५ हजार ४५७ (२००३-२००७), पाचोरा प्रांताधिकारी ९७ हजार ९० (२००१-०२ ते २००७-०८).

वाहने जमा करून चाव्या जिल्हाधिकाऱ्यांकडे!बीड, ता. १ - तालुक्‍यातील ग्रामीण भागात, वाड्या-वस्त्यांवर सातत्याने संपर्क, मंत्र्यांचे, "व्हीआयपीं'चे दौरे, नैसर्गिक आपत्ती, निवडणूकविषयक कामांसाठी दौरे करणाऱ्या तहसीलदार, नायब तहसीलदारांना जुनीच वाहने असून इंधनासाठीही अनुदान उपलब्ध नाही. आतापर्यंत पदरमोड करून थकलेल्या जिल्हाभरातील या अधिकाऱ्यांनी शेवटी बुधवारी (ता. एक) आपल्या ताब्यातील वाहने जिल्हाधिकारी कार्यालयात जमा करून चाव्या जिल्हाधिकाऱ्यांकडे सुपूर्द केल्या आहेत. राज्य तहसीलदार, नायब तहसीलदार संघटनेच्या नाशिक येथे झालेल्या अधिवेशनातच हा इशारा देण्यात आला होता. त्यानुसार गुरुवारी (ता. एक) संघटनेचे जिल्हाध्यक्ष व्ही. एल. कोळी, सरचिटणीस विजय राऊत, कार्याध्यक्ष मारुती उगलमोगले, कोषाध्यक्ष संगीता मुथा, के. बी. शिनगारे, संगीता सानप, जी. जी. पवार, राहुल जाधव आदींनी जिल्हाधिकारी बी. के. नाईक यांना भेटून निवेदन देत वाहने जमा करण्यात आली. तहसीलदारांना सर्व प्रकारची तातडीची कामे करावी लागतात. मंत्र्यांचे तालुक्‍यातील दौरे, नैसर्गिक आपत्ती, शेतकरी आत्महत्या, कायदा व सुव्यवस्था, निवडणूकविषयक कामे, मोर्चा, शांतताभंग, शासकीय वसुली आदी सर्व कामांसाठी दौरे करावे लागतात. शासनाने जुनीच वाहने पुरविलेली आहेत. मागील काही वर्षांपासून वाहनाला लागणाऱ्या इंधनावरील खर्च भागविण्यासाठी अनुदान उपलब्ध करून दिलेले नाही. त्यामुळे पेट्रोल, डिझेल पंपांवर इंधन भरू दिले जात नाही. वाहनाची दुरुस्ती गॅरेजवाले करून देत नाहीत. वाहने जुनी असल्याने सतत दुरुस्ती करावी लागते. यासाठी पदरमोड करून इंधन शासकीय वाहनात टाकावे लागते; परंतु आता तेही शक्य होत नाही. यासंदर्भात नाशिकला अधिवेशनात चर्चा झाली. अनुदान उपलब्ध न झाल्यास वाहने जमा करण्याचा इशारा देण्यात आला होता; परंतु तरीही अनुदान प्राप्त न झाल्याने ही वाहने जिल्हाधिकारी कार्यालयात जमा करून चाव्या जिल्हाधिकाऱ्यांच्या स्वाधीन करण्यात आल्या.

जिल्ह्यातील तहसीलदारांची आजपासून गांधीगिरीनाशिक, ता. १ - शासनाकडे थकीत असलेले पेट्रोल- डिझेलचे अनुदान अद्यापही न मिळाल्याने व जुन्या वित्तीय नियमाप्रमाणे तालुकास्तरावर गाड्या चालविणे अवघड झाल्याने आज जिल्ह्यातील पंधराही तहसीलदारांनी आपली शासकीय वाहने जिल्हाधिकारी कार्यालय आवारात आणून उभी केली असून, आजपासून त्यांनी गाडी न वापरता गांधीगिरी पद्धतीने आंदोलन सुरू केले आहे.प्रत्येक तहसीलदाराला शासनाने वाहन उपलब्ध करून दिले आहे. त्या वाहनासाठी लागणाऱ्या पेट्रोल- डिझेलचे १८ लाखांचे अनुदान शासनाकडे थकीत आहे. त्यातच पेट्रोलपंप चालकांना संबंधित ऑइल कंपन्यांनी अगोदर रक्कम भरा, नंतर डिझेल- पेट्रोल पाठविले जाईल, असा इशारा दिल्याने त्या पंपचालकांनीही तहसीलदारांकडे बिलाची मागणी सुरू केली आहे. ते पैसे मिळत नसल्याने त्यांनीही डिझेल व पेट्रोल देताना हात आखडता घेतला आहे. आजपर्यंत यातून मार्ग काढत दिवस काढण्यात आले, आता मात्र आंदोलनाशिवाय पर्याय नसल्याने आजपासून या तहसीलदारांनी आपली वाहने येथे आणून उभी केली. उद्यापासून (ता. २) तहसीलदार पायीच कार्यालयात जातील व तेथून शासकीय कामे करतील. तालुकास्तरावरील या प्रमुख अधिकाऱ्यांवर मोठी जबाबदारी असते. इतरांच्या मानाने त्यांचे वेतनही कमीच आहे. त्यातच शासनाकडे थकीत असलेले अनुदानही वेळेवर येत नसल्याने त्यांनी ऐन सणाच्या काळात आंदोलन सुरू केले आहे.

इंधन न मिळाल्याने तहसिलदारांची वाहनेजमानागापूर, ता. १ - इंधनाअभावी जिल्ह्यातील १४ पैकी नऊ तहसीलदारांनी त्यांची शासकीय वाहने बुधवारी सायंकाळी जिल्हाधिकारी कार्यालयात जमा केली. कार्यालयीन कामासाठी शासनाकडून पैसा मिळत नसल्याची तक्रार अधिकाऱ्यांची आहे. सुमारे २० लाख रुपयांची थकबाकी असल्याने इंधन, वीज कपातीसारख्या संकटांना तहसीलदारांना सामोरे जावे लागत आहे. उर्वरित पाच वाहने नादुरुस्त असल्याने त्या आधीच तहसील कार्यालयात धूळखात पडून आहेत. निधीसाठी ३० सप्टेंबरपर्यंत वेळ दिल्यावरही शासनाने पाऊल न उचल्याने हे पाऊल उचलावे लागल्याचे तहसीलदार संघटनेने म्हटले आहे. राज्यभर जिल्हाधिकारी कार्यालयात तहसीलदारांनी त्यांची शासकीय वाहने जमा केल्याची माहिती आहे. शासकीय कामकाजासाठी निधी द्यावा अशी मागणी गेल्या अनेक दिवसांपासून तहसीलदार संघटनेने शासनाकडे केली होती. ३१ मार्च २००७ नंतर वारंवार मागणी करूनही शासनाने निधी दिला नाही. परिणामी शासकीय वाहनांना लागणारे पेट्रोल, डिझेलही इंधन वितरकांनी देणे बंद केले. महावितरणनेही विजेची थकबाकी द्यावी अन्यथा वीज कापू असा इशारा दिला. त्यामुळे तहसीलदार चांगलेच अडचणीत आले होते. जिल्ह्यातील बहुतांश तहसीलदारांनीही यासंदर्भात जिल्हाधिकाऱ्याकडे निवेदन दिले होते. नाशिक येथे झालेल्या बैठकीत ३० सप्टेंबर ही शेवटची तारीखही दिली होती. त्यामुळे दिलेल्या मुदतीत शासनाकडून याकडे दुर्लक्ष झाल्याने बुधवारी सायंकाळी ९ तहसीलदार जिल्हाधिकारी कार्यालयात आले. त्यांनी शासकीय वाहनांच्या चाव्या निवासी उपजिल्हाधिकारी चंद्रकांत डांगे यांना सुपूर्द केल्या. ९ वाहने ही चालू स्थितीत आहेत, तर उर्वरित वाहने नादुरुस्त आहे. या वाहनांनाही दुरुस्त करण्यासाठी शासनाने निधी दिला नाही. त्यामुळे काही तहसीलदार तर विना शासकीय वाहनाने कार्यालयीन कामकाज करीत आहेत.

The wage hike would increase the financial implication for the Centre by Rs 17,798 crore annually and the arrears with effect from January 2006 would cost Rs 29,373 crore, Information and Broadcasting Minister P R Dasmunsi told reporters after the Cabinet meeting.
The government increased the minimum entry level salary of a government employee to Rs 7,000 against Rs 6,660 recommended by the Commission headed by Justice B N Srikrishna who submitted the report in March this year.
Consequently, it would push up the total emoluments of an employee at the lowest level beyond Rs 10,000 per month including allowances.
It also increased the rate of annual increment from 2.5 per cent to 3 per cent.
In the defence sector, it approved at least three assured promotions for all defence forces personnel and civilian employees under the modified Assured Career Progression scheme.
While civilians would get this after 10, 20 and 30 years of service, defence forces jawans would be promoted under ACP after 8, 16 and 24 years.
The hiked salary would be given to the employees beginning September this year and the arrears from January 2006 would be given in cash in two installments - 40 per cent this fiscal and 60 per cent in 2009-10.
The financial implication of Pay Commission on the General Budget would be Rs 15,717 crore and Rs 6414 crore on Railway Budget in 2008-09.
The government’s present salary bill is over Rs 70,000 crore and the pension bill is over Rs 30,000 crore.
Finance Minister P Chidambaram said the budget deficit target would be adhered to, despite the implementation of the Pay Commission recommendations.
The government for the first time approved Military Service Pay for armed forces personnel, under which officers would get Rs 6,000 over and above their pay per month.
The lowest limit of disability pension for defence personnel would be doubled to Rs 3100 a month.

नाशिक विभागीय आयुक्तालयाला "आयएसओ' मानांकन
(हेमंत पाटील - सकाळ वृत्तसेवा) नाशिक, ता. १८ - फायलींचा ढिगारा, कामाला दिरंगाई, अस्वच्छता या बाबी शासकीय कार्यालयांसाठी नेहमीच्याच झाल्या आहेत. मात्र आजच्या जागतिकीकरणाच्या युगात ही प्रतिमा पुसण्याचा प्रयत्न सुरू झाला आहे. नाशिक विभागीय महसूल आयुक्त कार्यालयाने कामकाजाला "स्मार्ट वर्क'ची दिशा देत गुणवत्ता व्यवस्थापन प्रणालीचा स्वीकार करीत "आयएसओ' मानांकन मिळविले आहे. हे मानांकन मिळविणारे भारतातील पहिले विभागीय आयुक्त कार्यालय होण्याचा मान नाशिकला मिळाला आहे. "ब्युरो व्हिन्टास' या संस्थेने सुमारे दीड वर्षे सातत्यपूर्ण तपासणी करून मानांकनाला आवश्यक निकषांची पूर्तता केल्यानंतर कार्यालयाला "आयएसओ ९००१-२०००' प्रमाणपत्र प्रदान केले आहे. हे मानांकन मिळविण्यासाठी कर्मचाऱ्यांना सहा महिने प्रशिक्षण देण्यात आले. त्यांच्या मानसिकतेत बदल करण्यात आला. "आयएसओ' मानांकनाच्या श्रेणीतील ९००१-२००० ही जरी सुरवातीची श्रेणी असली तरी शासकीय कार्यालयाने व कर्मचाऱ्यांनी अतोनात परिश्रमानंतर ते मिळवल्याचा आम्हाला अभिमान असल्याचे सहाय्यक आयुक्त (प्रशासन) प्रल्हाद कचरे यांनी "सकाळ'शी बोलताना सांगितले. नाशिकसह धुळे, जळगाव, नंदुरबार, नगर या जिल्ह्यांचा कार्यभार सांभाळणाऱ्या या कार्यालयाच्या कामकाजात मानांकन मिळाल्यानंतर मोठ्या प्रमाणात बदल झाले आहेत. कामांचा जलद व वेळेत निपटारा, कर्मचाऱ्यांच्या कार्यक्षमतेत वाढ, संगणकीकरणामुळे शासनाला वेळेत अहवाल जाऊ लागले आहेत. प्रत्येक कर्मचाऱ्याच्या कामाचे मूल्यमापन होऊ लागले आहे. कार्यालयात आलेले पत्र (काम) संबंधितांपर्यंत ऑनलाइन पाठवून त्या विभागाच्या कारकुनाने त्यावर काय कारवाई केली, काम किती दिवसांत झाले, प्रकरण प्रलंबित राहिले तर ते का प्रलंबित राहिले याची संगणकावर ऑनलाइन नोंद होत आहे. कार्यालयांतर्गत २० शाखांमधील ७२९ कामांची यादी तयार करण्यात आली आहे. स्वच्छतेची जबाबदारी खासगी संस्थेकडे देण्यात आल्याने कार्यालय "कार्पोरेट' कार्यालयाप्रमाणे सजू लागले आहे. सर्व अभिलेखांचे वर्गीकरण करून जुने अभिलेख कक्षात पाठविण्यात आले आहेत. ज्या अभिलेखांचा जतन कालावधी संपला आहे ते विहीत कार्यपद्धतीचे पालन करून नष्ट करण्यात आले आहेत. २६ संगणक असणाऱ्या कार्यालयात आजमितीला ९७ संगणक दाखल झाले आहेत. हे सर्व संगणक एकमेकांशी जोडण्यात आले आहेत. एका विभागाने केलेले काम दुसऱ्या विभागाने तपासणे, ते निर्धारित व प्रमाणित कार्यप्रणालीनुसार होते आहे की नाही याची तपासणी दर महिन्याला केली जात आहे. एखादा कर्मचारी रजेवर असला तरी तुमचे काम थांबणार नाही. कारण तो कर्मचारी करीत असलेल्या कामाचे रेकॉर्ड व संचिका सुव्यवस्थितपणे लावण्यात आल्याने त्याचे काम इतर कर्मचारी करू शकणार आहेत. नाशिक रोड परिसरात अनेक महसुल कार्यालये आहेत. मात्र, ही कार्यालये कधी आयएसओ प्रमाणपत्रे घेऊन आपला दर्जा सुधारतील असा प्रश्न नागरिकांकडून उपस्थित केला जात आहे. ---------------------------- असे मिळाले "आयएसओ' शासकीय कर्मचाऱ्यांच्या मानसिकतेत सर्वप्रथम बदल करण्यात आला. त्यासाठी त्यांना प्रशिक्षण देण्यात आले. कागदांचा ढिगारा कमी करून संगणकाचा वापर वाढविला. प्रत्येक शाखेचे मॅन्युअल, नियम, कायदे, कार्यपद्धती तयार करण्यात आली. प्रत्येक विभागाचे काम लिहून काढण्यात आले. त्यानुसार कामाला प्रारंभ झाला. ७१९ विषयांशी संबंधित ४१५ टेम्पलेट तयार करण्यात आले. "ब्युरो व्हिन्टास'च्या अधिकाऱ्यांनी वेळोवेळी केलेल्या तपासणीनंतर त्यांच्या निकषांची पूर्तता केल्यानंतरच कार्यालयाला हे मानांकन मिळाले आहे. ---------------------------- प्रत्येक टपालाची होतेय नोंद शासकीय कारभार हा बहुतांशी कागदपत्रांच्या माध्यमातून चालतो. पाच जिल्ह्यांचा कारभार बघणाऱ्या विभागीय आयुक्त कार्यालयात राज्यातील विविध शासकीय कार्यालयांतून रोज शेकडो टपाल येतात व पाठविली जातात. त्याची नोंद करण्यात कर्मचाऱ्यांचा मोठ्या प्रमाणात वेळ जात असे. काही प्रसंगी ते गहाळही होत. मात्र "आयएसओ' मानांकनानंतर झालेल्या संगणकीकृत व शिस्तबद्ध कामकाजामुळे कार्यालयात आलेल्या व गेलेल्या प्रत्येक टपालाची नोंद होत आहे. त्यामुळे कामात पारदर्शकपणा आला आहे. १ जानेवारी २००८ पासून आतापर्यंत कार्यालयात आलेल्या २७,९९२, तर पाठविलेल्या ८,५५८ पत्रांची संगणकावर नोंद झाली आहे. हे टपाल कोणाला, कधी, कुठे पाठविले, संबंधितांनी त्यावर काय कारवाई केली, प्रलंबित प्रकरणे किती, ती प्रलंबित का आहेत याची इत्थंभूत माहिती ऑनलाइन उपलब्ध होऊ लागली आहे. त्यामुळे कामात पारदर्शकपणा आला आहे. ----------------------------

For a state government which recently had a GAS promoteeIAS officer touching Chief Minister Narendra Modi's feet, this couldbe another bitter pill to swallow. NM Chavda was the only officer ofthe 11 who were selected by the UPSC in 2006 for promotion fromGujarat Administrative Service (GAS) to Indian Administrative Service(IAS), but was not appointed.He has scored a victory using Right to Information (RTI) Act.Chavda, whose father Motibhai Chavda was a minister in the MadhavsinhSolanki government, was number six on the list for promotion to IASfrom GAS prepared by UPSC.But as the state government withheld his integrity certificate,writing to the UPSC that there was one application pending againstChavda, his appointment was held in abeyance.After failing to get answers from the state government on the reasonsfor this, Chavda filed an application under RTI to the publicinformation officer (PIO) of UPSC.He sought a copy of proceedings of UPSC selection committee meetings(SCM) from 2003 to 2005 for promotion of state civil service officersto IAS. He also asked for copies of the correspondence from September1, 2003 till March 31, 2006 between UPSC and the state governmentregarding his selection.The PIO of UPSC refused to furnish details of SCM proceedings statingthat it contained information in respect to other officers and sharingof this required a policy decision to be taken by the centralgovernment, which was awaited. But that part of SCM from 2003 till2005 regarding officers included in the zone of consideration, thoseselected for appointment to the IAS can be supplied.Chavda's first appeal was disposed of by the UPSC upholding the PIO'sdecision. He was told that pending the decision of the government,UPSC had taken a policy decision that information should not bedisclosed to anybody till decided by department of personnel andtraining (DoPT).Before the CIC, Chavda appealed seeking that UPSC's decision be setaside and that at least information pertaining to him be given afterapplication of the severability clause.Responding to the appeal notice sent by CIC, the PIO of UPSC RichaMisra replied that without going into the merits of the groundsindicated in the appeal, following CIC's decision in the case of UPSCand Jyoti Legha, UPSC, through its order of October 16, 2007, haddecided to furnish copies of SCM proceedings.But this would be after severing the portion of the proceedings whichindicates the 'overall relative assessment'. Complete copies of theSCM proceedings minus the portion indicating overall relativeassessment could be provided. This being acceptable to Chavda, UPSCofficials handed it to him at the hearing.According to Chavda, who had been trying to get this information forthe last two years, the information would now help him in his casebefore the Gujarat High Court.

What is creamy layer according to Supreme Court
Whether "Creamy Layer" is to be excluded from SEBCs? (Socially and Economically Backward Classes) "Creamy Layer" is to be excluded from SEBCs. The identification of SEBCs will not be complete and without the exclusion of "creamy layer" such identification may not be valid under Article 15(1) of the Constitution. (Paragraph 152) 7. What should be the para-meters for determining the "creamy layer" group? The parameters contained in the Office Memorandum issued by the Government of India, Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training) on 08.09.1993 may be applied. And the definition of "Other Backward Classes" under Section 2(g) of the Act 5 of 2007 should be deemed to mean class or classes of citizens who are socially and educationally backward, and so determined by the Central Government; and if the determination is with reference to caste, then the backward class shall be after excluding the creamy layer. Procedure to issue income certificates
Supreme Court has come out with its landmark interpretation of rule on OBC. Now the issue of creamy and non-creamy layer will be crucial in getting reservations in higher educational institutes admissions.
I have not any detailed procedure for issuing income certificates as is laid for caste certificates.
Once upon a time some Rs. 4800 limit was for Durbal Ghatak Election in Co-Op sector and there was one GR authorising Tahasildars to issue of certificate of income to determine Durbal Ghatak. Thereafter, scholorships, EBC and for all other concessions, revenue officers used to issue certificates.
Never thought of workload issue, procedure issue and the consequences analysis of issuing wrong certificates which ultimately defrades state by way of siphoning constitutionally guaranteed consessions and reservations.
1. Who to issue caste certificate.
2. What should be procedure- process.
3. Appeal remedy.
4. Staff support. etc.
This is all about income certificate which latter forms basis of non-creamy layer certificate. If you feel this is also an important and crucial issue facing the cadres, then do not just read it and go browsing. Wait, think rationally, react and act pl.
Think Simple to Solve Complex Problems.
When NASA began launching astronauts into space, they found out that the astronauts' pens wouldn't work at zero gravity (ink wouldn't flow down to the writing surface). It took them one decade and $12 million to solve this problem. They developed a pen that worked at zero gravity, upside down, underwater, on practically any surface including crystal, and attemperatures ranging from below freezing to over 300 degrees C. And what did the Russians do? The Russians used a pencil. 2. One of the most memorable case studies on Japanese management techniques was the case of the empty soap box, which occurred in one of Japan's biggest cosmetics companies. The company received a complaint that a consumer had bought a soap box that was empty. Immediately the authorities isolated the problem to the assembly line, which transported all the packaged boxes of soap to the delivery department. For some reason, one soap box went through the assembly line empty. Management asked its engineers to solve the problem. Post-haste, the engineers worked hard to devise an X-ray machine with high-resolution monitors manned by two people to watchall the soap boxes that passed through the line, to make sure they were not empty. No doubt, they worked hard and they worked fast but they spent whoopee amount of time and money to do so. But when a rank-and-file employee in a small company was posed with the same problem, he did not get into the complications of X-rays, etc but instead came out with another solution. He bought a strong industrial electric fan and pointed it at the assembly line. He switched the fan on, and as each soap box passed the fan, it simply blew the empty boxes out of the line. 3. A 50 feet long trailer having 48" wheels got stuck while entering amidtown tunnel in New York because it was approximately 2.5 feet taller than the height of the tunnel. The fire department and the state department of transportation spent the whole day searching for a solution, to no avail. Then a child, aged about 9 years, asked his father, "Why can't they take out the air from the tyre tubes? Tahasildar Haveli digs out RTI Act being misused, CIC directs probe-
One person files 73 applications in different names **Pune, April 07:* If the Right to Information (RTI) Act empowered citizens by providing a weapon to keep a check on the administration and bring in transparency in Government functioning, the flip side is the misuse of the Act. An individual has been identified seeking information under the RTI for commercial use and Chief Information Commissioner (CIC) has asked for a report in the 73 cases filed by him on behalf of different applicants. "The possible misuse of the RTI Act came to light on a report submitted by tehslidar of Haveli taluka and Appeal Authority for Haveli taluka. It was revealed that 73 applicants with different names had filed appeal with the commission and handwriting in the applications also matched," ChiefInformation Commissioner (Pune division) Vijay Kuvalekar said.Doubts emerged after the Appeal Authority for Haveli taluka submitted during a hearing that an application has been filed with the common address not by the applicant, but a person, M N Patil, on behalf of the applicant, Kuvalekar said.The CIC directed the tehsildar Sanjeev Deshmukh to send notices to all the 73 applicants on the given address while requesting them to appear in person for the hearing and submit a detailed report.Deshmukh said he was receiving a lot of RTI appeals from the same address — in the name of various applicants, and that none of them appeared for the hearings.As per CIC's directions, Deshmukh said he served notice on the applicants on the common address.Only two of the 73 applicants replied. It was revealed that Patil offered services like providing documents related to 7-by-12 extract to the applicant for cash and took signatures of clients on blank paper.The signed papers have been converted into RTI applications by Patil without the knowledge of his clients. Deshmukh said the documents, information sought through RTI Act is given to the client and if they are incomplete, then an appeal is filed.The inquiry further revealed that Patil was involved in a similar activity in Mulshi taluka. The appeal authority and tehsildar of Mulshi Avinash Shinde said, "We were fed up with the number of applications coming in from a common address seeking various information." Suspecting foul play, Shinde asked the police to investigate the cases by verifying the identity of the applicants on the given address. The police have submitted a report that none of the applicants reside in the given address and a person named, M N Patil, is using the property. He has admitted to filing the RTI applications on behalf of various persons, he said.The CIC has expressed concern over the entire matter. "The commission is taking a serious note of it as the matter was serious and objectionable since it would encourage misuse of RTI Act," Kuvalekar said.
Support innocents who are likely to be victimised.
I do not know facts. But I hate " Sap Sap mhanun Bhui Dhopatane". Here is always chance of innocents getting victimised and we all should bear cardinal principle of law that " let 100 offenders scot free but see that no single innocent should be made to suffer.
I have every sympathy and support for all innocents those who are subjected to suffer. And I am sure our revenue fraternity would also support all the innocents who are likely to suffer no fault of theirs.
Never be under wrong pressure, may it be media or otherwise. Such tactices need to sorted out logically and rationally not emotionally. Unfortunately Sholapur is in trouble once for Sanjay Gandhi, then for EGS and now seems to be for Food & Civil Supply. One can imagine the stress and strain our revenue community in Sholapur district is living under.
Nobody except those few in the helm of affair know what is fact, what is true and what is false. Let law take its own course, let scrutiny take place but in a lawful manner,but not under pressure.
I know all share joy, happiness and laxury at the cost of others, but when the persons at helm of affair suffer, all cowards run away. Those who have enjoyed must be running away leaving poor chaps to suffer for knowingly or unknowingly committed wrongs or may be for right things being interpreted in wrong spirit.
One thing we all should remember, when someone talks about Food and Civil Supply things, if we cry 100 times for true things people disbelive for the system is in mess and disrepute.
But anyway, time has come like caste certificate we should ourself say take out this work which unncessarily brings disrepute to Reveune People. How many will agree with me?

MUMBAI: It is unfortunate that in an unprecedented punitive measure, the Maharashtra legislative assembly on Thursday sent state election commissioner Nandlal to two days’ simple imprisonment for contempt of the House. The inprisonment seems to be in civil jail. Now is Arthur jail a civil jail? Couldnt custody of collector mumbai have been a civil jail. What are Civil Jail Rules. New Land Acquisition Bill 2007
Now the THE LAND ACQUISITION (AMENDMENT) BILL, 2007 A BILLfurther to amend the Land Acquisition Act, 1894.18. is going introduced in loksabha so if we propose ammend ment to sec 18 as court referance is tobe given by agency then it will be possible. ammended sec 18 of La 1984 bill 2007 is as folloeIn section 18 of the principal Act,-(i) in sub-section (1), the following provisos shall be inserted, at the end, namely:—“Provided that the Collector shall, within a period of fifteen days from thedate of receipt of application, make a reference to the Authority for the Centre, oras the case may be, the Authority:Provided further that where the Collector fails to make such referencewithin the period so specified, the applicant may apply to the Authority for theCentre, or as the case may be, the Authority, requesting it to direct the Collectorto make the reference to it within a period of thirty days.”;(ii) in sub-section (2), after the proviso, the following proviso shall be inserted,namely :—“Provided further that the Collector may entertain an application after theexpiry of the said period, within a further period of one year, if he is satisfied thatthere was sufficient cause for not filing it within the period specified in the firstproviso.”. Why dont we first get the comments/problems of all SLAOs and then hold a conference of all SLAOs at state level and invite some distinguished lawyers, judges et al. Responsibility of SLAO has to be limited.
The point mentioned is what I have been trying to make since I was Chitnis in Nashik.Most people only refer to section 18 of the Land Acquisition Act 1894, conveniently forgettingsection 20 of the same Act. While it is the responsibility of the SLAO to accept the referenceunder section 18 and forward it to the Civil Court, under section 20, it is the responsibility of theCivil Court to issue notice to the Collector if the reference contains details regarding the valuationof land, trees and structures. Till such notice is received, the Collector is under no duress to respondlegally to the Civil Court. Even the references presented to the Collector/SLAO are worded in sucha way that make SLAO a party to the case, whereas the simple logic is that when the Land Acquisitionproceedings are commenced the AB is the applicant and the land owners are the non-applicants.Therefore by common logic, when the land owners become the applicant (under section 18 reference)the AB automatically becomes the non-applicant. We should therefore reject such references where Collector/SLAO are made parties, but we still send them to the Civil Court. Once the Civil Courtentertains such references, it goes by the Code of Civil Procedure (which most of us are notfamiliar with). This leaves us at the mercy of the AGP (in lighter vein Anti-Government Pleader!).It is time we make some effort to reduce our own problems! K Suryakrishnamurty
Acquiring body should file the appeal
SLAO/Collector should not take decesion regarding filling appeal .Acquiring body should file the appeal immidiaetly in case enhancement ordered in reference under section 18 is not acceptable .. SLAO works as a facilitator to the acquiring body.Once award is declared his works mainly confines to payment of compensation . It is logic that who is aggrived should approach the court. For any amount of compensation awarded in reference under sec 18 , SLAO has no reason to be aggrieved as it is acquiring body who has to bear the same.As far as Land Acquisition Office at Panvel is concerned, one awwal karkun or SLAO has to attend the District Court or High Court daily as large number of References u/s 18 or appeals are pending.Existing machinary is unable to cope up with the work pressure and Court litigation. This office has acquired land for CIDCO for the development of Satellite Town- New Mumbai. As prices of the land on the periphery of Mumbai have sky-rocketted ,the farmers in the area are desperate to fetch higher price.Awarded compensation is accepted under protest and farmres are moving to the court.Mumbai is 50 KM away from Panvel whereas Alibaug where District Court is located is 60 KM.So farmers have easy access to both of these Courts.So number of references u/s 18 or appeals are comparatively high than the other offices. Appeal Memo are drafted by Solicitor Firms containing more than 20 pages (one sided).Replying the same becomes difficult in short peroid .( No comments about GP)Beside the acquisition for CIDCO is carried in the year 1970 to 1980, record is ill maintained. So some time getting the various record required for court work is trouble some.Man power at various Land Acqisition Offices is meagre one.It is heard that Government is in the phase perparing new staffing pattern for SLAO offices across the state. Hope proper strength is provided.Offices of SLAO are on temporay basis.Continuation is given for short period, i.e two months.So after every two months ,continuation proposal is required to be submitted to the governments. As per R& F department GR, SLAO offices are to be provided all amenities at par with SDO viz.Vehicle, telephone, Photo copying machine, computers -printers. I am not sure whether even telephones are provided to all offices.This is affecting the morale of the staff esspecially SLAO.Proposed LA(Amendment ) Bill 2007 is pending before the parliament regarding acquisition for the companies. I think certain sections should be inserted regarding the provision of appeal by the acquiring body or rule to that effect be made.In LA act , no principle is set regarding methods of determining compensations. As a result various valuations methods are being adopted and no uniformity is maintained for the same.This is one of the grave cause for inaccurate determination of compensation which gives rise to court litigation. In Maharashtra Engineering Services direct recruitment is at three levels. Asstt. Executive Engineer(AEE) , Asstt. Eng. class-I(AE_I) , Asstt. Eng. Class-II(AE- II). AEE & AE-I are selected in the grade 8000-275-10500/ -& AE-II in 6500-150-... ..grade. AEE is initially posted as AE-I i.e.Dy.Eng. After completion of probation of 2 yrs.& one term of 3 yrs. in AE-I grade i.e. after 5 years he is automatically promoted as Executive Engineer in the grd. 10500-13500/ -. Seniority lists of AEE and AE-I are maintained seperately till they are promoted in cdr of EE.
This can be applied for Revenue Cadre also, by upgrading Dy. Collector to 10500-13500/ - grade and Tahasildar and Naib Th. to 8000-10500/- and 6500-....grade.

Land Acquisition Important
In a recent case of SLAO Metro Centre No.1 in Panwael Civil Application No.3422/07 Hon. Chief Justice of HC Mumbai & Hon. Justice J. P. Devdhar on 4th Feb. 2008 took a serious view on manner of filing appeals in Land Acquisition Cases. The Court issued show cause notice to Govt. Pleader why action should not be taken for inordinate delay in filing the appeal. Delay in the said case is of 722 days. The Hon. High Court observed "We may futher indicate clearly that the principle of public accountability is applicable to the administrative actions. Executive is under obligation to work in a proper manner and act to the expected standards causing least prejudice to the interest of the state."
" In the aforesaid circumstances, before we consider the question as to whether such inordinate delay should or should not be condoned, we issue show cause notice the state officials, who did not act in the matters and created huge liability on the state, as to why they should not be directed to pay interest payable to the claimants for all these period."
This order of the High Court is circulated by the R & FD to all Collectors
Ref. R & FD No. Sakirn-08/141/Cr-20/A-4 dtaed 14th Feb 2008. Pl. get this, circulate it to all our coleaugues. Now time has to be accountable and adopt smart style of working. Here are number of issued in the matter. We need to discuss, deliberate to thread them out one by one and to get a standard procedure of filing appeal from Government. There is lot of interdependence as GP Dist. Court-Agency-GP High Court- Stamp Duty Amount- Expndr.needed and then filing of affidavit. We are always reviewed. Whether pendency of GP HC is reviewed anywhere but still for their delay SLAO has to take onus of delay on his head in affidavit. Cadre Strenghtning Necessary
Lot has been said and done regarding cadre strenghtning of deputy collectors,tahsilda rs,naib tahsildars.. .......I ve Some points which i think should be discussed first which r as follows1...Total strength of each cadre (total sanctioned ,permanant,temporar y...)2...Actual Strength (No of posts filled, vacant)including posts on deputation3...Seniorioty Lists (not yearwise.... .alll...till date4...Pay scale transisions (from creation of cadre)5...Posts at Par (i mean compared to other departments hirarchy)6...Pay scales of the posts of other departments for comparision7...working conditions thereto I think by not taking these points into consideration we r degenerating ourselves... for example OUR DEPUTY COLLECTOR WORK AS DEPUTY COMISSIONER IN MUNICIPAL CORPORATION UNDER HIS BATCHMATE C.O.(WHO IS COMMISSIONER FROM CO CADRE)SO think seriously... ......... ........Ravindra Dhurjad RDC Yavatmal Amravati divn
Different Viewpoint on Caste Certificate Issue
I have total different opinion regarding cast certificates. As we all know that there is a scrutiny commity for scrutiny of cast certificates- -then why there is need of issuing authority?. If you are goingg to become a MAHASATTA, why did you do the same work twice. So insted of doing issuance + validity ------do only validity okkkkkkkkkkkkkkk. As we all were, aware that validity committee is doing its job in a nice manner, let them allow to do the job of validity. SO GOVT SHALL NOT WASTE THE TIME OF REVENUE OFFICERS FOR CAST CERTIFICATE, rather than this govt should give them a another work. That doesnt mean that we are avoiding the work but we just want to avoid the double work. However , govt may appoint more staff to validity office and can also appoint another seniour REVENUE officers for doing the appeal work . Caste Certificate Issue
What Abhijeet has stated is correct. Ealier during our schooling days, School authorities were not insisting on the production of caste certificate for recording our caste in the school record. They use to record the same on the basis of verbal information suplied by the parents. Nowdays esspecially Mumbai, unless caste certificate from the Competent authority is produced ,no fee concession is granted to the student who claims for the same under reserved category.
Beside Caste Certificate (Issuance and Regulation ) Act does not stipulate any age criterion for claiming the caste certificate. It is advisable that on the lines of Khate pustika , Caste Book-let for a family may be issued at once so that members from the same family need apply seperately.New born child will have the caste status of his family by proper endorsement of competent authority. My viewpoint on Caste Certificate issue
Caste Certificate are important.But i have some suggestions. Mr. Nikam Sir has said that we should issue caste certificate only who really requires it. You can't judge who is in real need and who is not.There are some places where citizen requires caste certificate without scrutiny committee's verification for example various govt. schemes run by tribal dept, Panchayat Samiti, Z.P., social welfare dept.So you can't restrict incoming of caste certificates. Also wheather age of person is two month or 70 years , it doesnot make any difference. If he want the certificate , we should give it. Abhijeet BhandeTahsildar Raver.
Permenant Residence
As far as I know, there is no such thing as permanent residence for issuing caste certificates.The para reads "the term "ordinarily resident" here will have the same meaning as in section 20 of R.P.Act", so no question of permanent residence arises. Either way that idea seems so outdated in this age of transbordermigration on such a large scale. Suryakrishnamurty
